Welcome to Soul Water Divers (“we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of our website, communication channels, and all diving, training, and related services provided by Soul Water Divers.
By booking a dive, course, or package, or by visiting our website, you agree to these Terms and Conditions.
If you do not agree, please do not use our services.
1. Company Information

2. Services Provided
Soul Water Divers offers professional diving activities and training, including but not limited to:
- Cenote and ocean diving tours
- Cave and technical diving (for certified divers)
- PADI-certified Open Water and Advanced Open Water courses
- Custom dive packages for groups, retreats, and events
All services are delivered under the direct supervision of Alonso Cuadrado, a PADI-certified instructor with over 15 years of experience.
3. Eligibility and Certification Requirements
- Participants must meet the minimum age, health, and certification requirements for the dive or course selected.
- Certification verification (PADI or equivalent) may be required before certain dives (e.g., Advanced, Cave, or Bull Shark).
- Soul Water Divers reserves the right to deny participation to anyone who does not meet the required safety or medical standards.
- Divers must complete a medical questionnaire and sign a waiver and liability release prior to participation.
4. Safety Policy
Your safety is our top priority. All dives are planned and supervised according to PADI and international diving standards.
Participants agree to:
- Follow all safety briefings and instructions given by the instructor or guide.
- Refrain from consuming alcohol or drugs before any dive.
- Disclose any relevant medical conditions prior to diving.
Soul Water Divers reserves the right to cancel or modify a dive for safety reasons, including but not limited to: weather, visibility, health concerns, or environmental conditions.
5. Payments and Pricing
- Prices are listed in Mexican Pesos (MXN) unless otherwise stated.
- Payments can be made via cash, bank transfer, or credit card.
- Full payment or a deposit may be required to confirm a booking.
- Outstanding balances must be settled before the dive or course begins.
All prices include: tanks, weights, guide, park fees, transportation (unless specified), snacks, and professional guidance.
Gratuities are optional but appreciated.
6. Cancellations and Refunds
We understand plans can change. Our policy is designed to be fair to both our divers and our team:
- Cancellations made 48 hours or more before the scheduled dive: Full refund or credit toward future booking.
- Cancellations made less than 48 hours before the dive: 50% refund or credit.
- No-shows or same-day cancellations: No refund.
- Weather or safety cancellations (initiated by Soul Water Divers): Full refund or reschedule option.
Refunds are issued in the same method as payment within 7 business days.
7. Rescheduling Policy
We are happy to reschedule your dive or course subject to availability.
Please contact us at least 24 hours before your scheduled start time.
No additional fees apply for rescheduling due to weather or safety conditions.
8. Liability and Assumption of Risk
Diving involves inherent risks, including injury, decompression sickness, or drowning.
By participating in any dive, course, or activity, you acknowledge these risks and agree to assume full responsibility for your participation.
You further agree that Soul Water Divers, its owner(s), instructors, guides, and contractors shall not be held liable for:
- Personal injury, illness, or property loss occurring before, during, or after the activity;
- Circumstances beyond our control, such as weather, transportation delays, or equipment malfunction;
- Actions of other participants or third parties.
All participants must sign a Release of Liability and Assumption of Risk Form before any in-water activity.
9. Insurance
We recommend all divers carry valid travel insurance that covers diving-related activities.
Soul Water Divers is insured as a professional diving operation but is not responsible for costs related to personal medical treatment, evacuation, or lost property.
10. Equipment Use
- All rental equipment is regularly inspected and maintained.
- Participants are responsible for proper care and handling of the equipment provided.
- Damage due to negligence may result in repair or replacement fees.
Divers may use their own gear, provided it is in safe and serviceable condition.
11. Media and Content
We may take photos and videos during dives or courses for safety documentation or marketing purposes.
You may request not to appear in promotional media by informing your instructor before the dive.
All images and videos provided to clients are for personal use only and may not be sold or used commercially without permission.
12. Privacy
We respect your privacy.
Any personal information collected during booking or communication is handled in accordance with our Privacy Policy and applicable data protection laws.
13. Force Majeure
We are not liable for any delay, cancellation, or change in itinerary caused by circumstances beyond our control, including natural disasters, extreme weather, accidents, illness, or government restrictions.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Mexico, particularly those applicable in the state of Quintana Roo.
Any disputes arising from these Terms shall be handled through amicable negotiation, and if necessary, resolved under the jurisdiction of the competent courts in Quintana Roo.
15. Changes to These Terms
We may update these Terms from time to time to reflect operational or legal changes.
Any updates will be posted on this page with the date of revision.
Your continued use of our services constitutes acceptance of the updated Terms.
